Terms of Service

These Terms govern the use of TCGMarketplace.eu and distance sales made through the online store.

I. General Provisions

These Terms govern the relationship between Scarlet Games Ltd., Company ID 207330198, VAT BG207330198, registered address 19 Han Asparuh Street, Plovdiv 4000, Bulgaria (the “Merchant”), and persons using TCGMarketplace.eu (the “Customer” or “Consumer”).

TCGMarketplace.eu offers collectible and hobby products, including sealed TCG products, booster displays and boxes, booster packs, starter and structure decks, collections, single cards, graded cards, accessories and pre-order products.

By placing an order, the Customer confirms that they have had access to the applicable terms and required pre-contract information. Mandatory consumer rights under applicable Bulgarian and European Union law are not limited by these Terms.

III. Products, Information and Prices

We take reasonable steps to keep product descriptions, images, specifications, availability and prices accurate. Minor visual differences may occur because of display settings, print variations, manufacturing batches or the illustrative nature of certain images.

The final product price and applicable shipping charges are displayed before the order is completed. If there is an obvious technical error in a price, description or availability, we may contact the Customer and act in accordance with applicable law, including offering fulfilment under corrected terms or refunding amounts paid where the order cannot lawfully be fulfilled.

Publication of a product does not guarantee permanent availability.

IV. Orders and Contract Formation

The Customer selects products, provides the required information and confirms the order through the store's checkout process. Before final confirmation, the Customer can review the products, quantities, price and applicable delivery charges.

The Customer is responsible for the accuracy of the information provided. An automated email may acknowledge receipt of an order. The legal effect of individual communications depends on their content and applicable law.

We may refuse fulfilment where there is objective impossibility, exhausted stock, an obvious technical error, reasonable suspicion of fraud, abuse of announced purchase limits or another lawful reason. Any prepaid amount that must be refunded will be returned in accordance with the applicable payment and legal rules.

V. Payment

Available payment methods are shown at checkout and may include payment cards, bank transfer and other supported electronic methods. Where payment is processed by an external provider, payment-card data is handled by that provider under its own rules and applicable law.

VI. Shipping and Delivery

Orders are delivered to the destinations and through the methods available at checkout. Delivery times may be estimates unless expressly agreed otherwise. Mandatory consumer rights concerning delivery times remain unaffected.

If a parcel arrives with visible transport damage, we recommend documenting the condition and notifying the carrier and TCG Marketplace as soon as reasonably possible. This recommendation does not limit any statutory rights.

VII. Pre-Orders and Distributor Allocation

A product marked PRE-ORDER is a product whose official release or delivery date is still upcoming. Release and delivery dates may be estimates and can be changed by the manufacturer, publisher or distributor.

Some releases are subject to distributor allocation. If we receive less stock than expected and fulfilment of an affected order becomes impossible, the Customer will be notified and the amount due for the unfulfillable portion will be refunded.

Quantity limits may be announced for limited products by customer, address, household or order. Attempts to circumvent those limits may result in review and lawful adjustment or cancellation of the affected order.

VIII. Random and Collectible Contents

Booster packs, booster boxes, booster displays and other products with random contents are sold as the specified sealed product and not as a guarantee of receiving a particular card or market value.

Except for content expressly guaranteed by the manufacturer, we do not guarantee a specific card, rarity, grading result or financial return. Not receiving a desired or high-value card does not, by itself, constitute non-conformity.

IX. Singles and Graded Cards

For individual cards, we may state the condition and provide images of the specific card offered for sale. For a graded card, the subject of the sale is the specific card in the specific holder or slab with the grade assigned by the stated grading company.

No guarantee is made that a regrade or a different grading company would assign the same grade.

X. Right of Withdrawal and Returns

Consumers who have a statutory right to withdraw from a distance contract may exercise that right within the applicable 14-day period, except where a legal exception applies. The collectible nature of a product does not, by itself, remove mandatory statutory rights.

The Consumer may be responsible for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, where provided by law. Breaking factory seals, shrink wrap or original security packaging, opening packs or boxes, or damaging a graded-card holder can materially reduce value.

The right of withdrawal is separate from rights relating to defective or non-conforming goods.

XI. Complaints and Product Conformity

Consumers retain all statutory rights relating to non-conforming goods under applicable law. To help us review an issue efficiently, the Customer may provide the order number, a description of the issue and relevant photos through the Contact page. Failure to provide photos does not remove statutory rights where such rights apply.

XII. Unclaimed Parcels and Abuse Prevention

If a parcel is not collected, we may offer reshipment and may request reimbursement of actual additional transport costs where legally permitted. In cases of repeated non-collection, we may lawfully restrict certain payment methods for future orders.

Where there are reasonable indications of fraud, chargeback abuse or unauthorized use of a payment instrument, we may take proportionate steps to verify the transaction and protect our rights.

XIII. Business Customers

Where a purchase is made by a person acting in the course of a trade, business or profession, rules that apply exclusively to consumers do not apply unless the law provides otherwise. Separate B2B or wholesale terms may be agreed for specific commercial orders.

XIV. Intellectual Property

Original text, graphics, design and other protected materials belonging to TCGMarketplace.eu may not be used without permission. Third-party trademarks, product images and brand identifiers remain the property of their respective rights holders.

XV. Liability and Events Outside Our Control

We are not liable for temporary interruption or delay caused by circumstances outside our reasonable control to the extent permitted by law. Nothing in these Terms excludes liability that cannot lawfully be excluded.

XVI. Governing Law and Disputes

Matters not expressly addressed in these Terms are governed by Bulgarian law and applicable European Union law. Consumers retain any mandatory rights to bring a matter before the competent authorities or courts under applicable law.
